Hello, I’ve only been on here for about a week or so (light reading).

I took interest in your topic and I’m curious as to how they will know if you didn’t take it out but said you did?

I wonder if they would buy a cheap pet chip in a vial of clear liquid along with a bandage at the location.

If he tries to fool them and they get wind of it, they might sue him. And then he’ll be in a world of legal fees and attorney bills - without a job to pay for them on top of that.

Still can’t see that being legal… thats like getting fired because of a piercing

Like I said, it can only be legal if the piercings / tattoos prevent the employee from doing their job. Typically, someone working retail, or trolley dollies.

In this case, it doesn’t. So yeah, how this is legal is beyond me. But he’ll be skint before he reaches judgment day if he drags them to court over this.

Thats my point it dosnt effect it in any way so…

I guess (just guess!!) that the lawyer came to this decision, because the technology itself is the issue, not the implant. I.e.: it might be ok having silicone shape, but chip with memory is no-no.

In theory if someone was about to say:
ā€œI want to eat the cake and have it!ā€
would it be possible to fry the chip, prove that is out of order, leave it where it is, and keep the employment?

I am not suggesting anything at all. But answering this maybe could help the church project.

Ya but because my employment is ā€˜at will’ they can fire me for any reason that doesn’t show discrimination.

It goes against logic to hire ā€˜at-will’!
Me, as a reasonable person would like to keep my employees at flow stage.


And perhaps the best way to do so is establishing a safe environment in terms of predictability. Maslow pyramid - second shelf!!!

I feel second-hand anger, and fear to get into similar pickle.

Edit: Let’s hope they think the same way I do, and you can keep your job until you find a better one!

As someone in the area of effect of this, it makes me very unhappy

I feel like there are still plenty of reasons this could be challenged in court but lawyers are lazy and only touch stuff if it’s covered by non discrimination protected class

My response would probably not be very tactful if I had to remain employed by them

I might even go in with a scalpel, and insist they do it themselves, and or witness me do it myself, as much shock factor as I can

Because they don’t know body shops can remove and it wouldn’t be a hard sell that a doctor can’t / won’t remove it

I would also fight tooth and nail and dirty, that THEY pay for it, because it’s amazing what financial motivation can do to change people’s minds

Of course, there’s also the easy thing of just slapping a bandaid on for a couple days and lying your ass off, they wouldn’t even know what to feel for

We don’t know the nature of the job.
Me, as a photographer can advertise for jobs so specificly that in other industries it would be illegal. Technically I can discriminate… but not.
I can decide who to hire based on the size of the nipple or accent if I like.

Does anybody else have a similar implant?
If not, and if the fact that you’re are being fired because of it. IS discrimination

Worth a try.

At the end of the day, your job is the food in your belly and the roof over your head.
Let them win the battle ( but make them work for it )
Drag it out
Get their objection in writing, and then you can fight to mitigate their issues.
It will buy you some time to fight your cause or find alternative employment.

THEN you can win the war.

I don’t envy your position buddy, I know what I would do, but you need to make this decision yourself.

Ok so a quick google tells me 43 US states are at will, with some having a little more protection than others.

Ya I’ve made my decision I don’t have the resources to fight this battle. I can always buy new ones, I’m just freeing up realty for later.

The stupid it sounds the true it is.
Some castings are really-really specific! If they have an actor and they need the younger/older version of the character… you can imagine.

Very frustrating because this state recently passed a law, prohibiting employers from mandating chips etc and all that, but not a single peep about if you already have one

Talk about hypocrisy

I say that if you are going to let them win, at least make them work for the victory. and try to get them to pay for it and give time off for the recovery from the stab wound they forced upon you. (and it might give you time to find somewhere else to be because I just wouldn’t want to stay there after they pull a stunt like this)

Agree to disagree, I think you’re giving all future employers ammunition to do this again

I’d just say you did and don’t ask don’t tell worst case

But like @MTFT said, don’t give them the easy win
Get EVERYTHING in writing, make them decide how they are to be removed, tell them you don’t know how, tell them you’ll need a couple days off work (workmans comp since your hand was cut open) etc

Them firing you for not ā€œknowingā€ how to, or trying to cooperate and then firing you anyways opens up other alternative recourse

You might not be able to change their mind, but you can bury them in minutiae, that they stop caring

From what I learned on my own doesn’t seem like this job is good enough for the hassle

Also, try taking @amal up on his offer to talk to them or at least give faking it a shot because its not like they have a way of checking. You have options to try before just giving up…

  • Most chips arent visible under the skin,
  • they cant ask for a document saying it was done because if they didnt ask for it before you did it you can say the doc didnt give one since they didnt ask before
  • they wouldnt know what to feel for
  • they wouldnt know how to find the sweet spot to test it with a reader
  • they wouldnt need to question it if you show them a cheap pet chip in a vial
    as long as you dont try to use it for doors or computers or anything on site, they cant know!
